My question involves a child custody case from the State of: California
My ex husband and I had joint legal and physical custody of the children. We lived in the same county and the kids went back and forth equal time unless the step parent scheduled stuff for the kids on my days and we would fight over it sometimes the kids would go to the scheduled events and sometimes they wouldn't. The father is now deceased from internal bleeding secondary to alcoholism. I currently live out of state, because my new husband is a military officer and we have had to relocate, and have the last five years while the kids stayed with their dad full time and they came to me for summers and holidays. I currently have the kids in Florida and since I am currently their only legal parent I am moving them to live with me full-time. I contacted lawyers before I made this choice and they all said I have every legal right to move them. Now that the step mom knows this she wants to take me to court to gain custody of my kids based on the fact they have their friends, grandpa(my parents are here in Florida with me) and schools there. In past cases how has California courts ruled in situations like this. I am a retired firefighter, my husband is an officer in the military. We will not have to move again because my husband will transfer while me and the kids stay here so they can finish high school. I own my own business and set my own hours to be with the kids and watch after them at all time.
