My question involves collection proceedings in the State of: Missouri
Hello, in 2007 while I resided in Kentucky a collection agency obtained a judgement against me for 5K.....2 weeks ago the vendor (ADP) who processes payroll for the company I work for in Missouri, started to garnish my wages @ 25%.....I have lived in Missouri since 2009
How can a vendor like ADP garnish my wages when the collection agency who obtained the judgement against me in Kentucky, never domesticated the judgement in Missouri where I live ???
Under Missouri law I qualify for the "Head of Household" exemption limiting a garnishment to 10%.....having contacted ADP and faxing them an affidavit stating my HoH status.....they dismissed it as not relevant to the Kentucky judgement.(Kentucky doesn't have a HoH limitation)
Am I not supposed to be afforded a 30 day notice of a civil hearing regarding this out of state judgement so I can argue that it has already been paid ? And if something is owed due to interest over the last 10 years shouldn't I be afforded the Missouri 10% wage garnishment HoH limitation ?
I have contacted two local attorneys who state they shouldn't be able to garnish my wages without first domesticating the judgement.....but then go on to say maybe ADP as my employer's payroll vendor has an office in Kentucky and that's how they skirt the "sister state" issue. They offer no other help then to suggest I hire an attorney in Kentucky......that doesn't seem right to me
Any help/suggestions ?
